Despite strong opposition from the business community (including New Jersey’s franchised dealerships), Governor Murphy signed a bill (S2310/ A4151) into law yesterday that requires employers’ to disclose the hourly wage or salary (or a range of the hourly wage or salary), as well as a general description of the benefits and other compensation program for which a new or current employee would be eligible in job postings. The new law, which goes into effect on June 1, 2025, applies to:
- employers with 10 or more employees over 20 calendar weeks;
- new jobs and promotion opportunities (defined as changes in job title and an increase in compensation) that are advertised by an employer either externally or internally.
The law does not prohibit an employer from making a promotion on an emergent basis, due to an unforeseen event. The law also doesn’t prohibit an employer from increasing the wages, benefits, and compensation identified in the job opening posting at the time of making an offer of employment to an applicant.
An employer who violates this law shall be subject to a civil penalty not to exceed $300 for the first violation and $600 for each subsequent violation, collectible by the Department of Labor.
